If you’ve been injured by a drunk driver, our team of experienced Tampa DUI accident lawyers can help you get the compensation you deserve.
The statistics reported were as follows:
Drunken driving fatalities per 100k residents: 4.7 (1,019, 27% of all car crash fatalities)
Fatalities involving driver with BAC 0.15 and above: 3.2 per 100K (688, 67.5% of all drunken driving fatalities)
Change in drunken driving fatalities from 2012: 43.7% increase
Drunk driving accidents entail extra specialized knowledge and investigation in order to ensure you are fairly compensated.
While the drunk driver's liability may not be at issue, there may be other negligent parties. In some cases, the bar or establishment may be held responsible for knowingly serving the intoxicated person. This type of claim is regulated through a separate set of laws commonly referred to as Dram Shop laws. Dram Shop laws are state regulations that hold providers of alcoholic beverages accountable for the careless actions of their drunk patrons. These laws give victims of a drunk driving accident the ability to pursue legal action against a third party, such as a bar or social host, who served alcohol to the intoxicated driver.
Florida has a very restrictive dram shop law.
Florida Statute §768.125 provides that:
“A person who sells or furnishes alcoholic beverages to a person of lawful drinking age shall not thereby become liable for injury or damage caused by or resulting from the intoxication of such person, except that a person who willfully and unlawfully sells or furnishes alcoholic beverages to a person who is not of lawful drinking age or who knowingly serves a person habitually addicted to the use of any or all alcoholic beverages may become liable for injury or damage caused by or resulting from the intoxication of such minor or person."
Because of this, proving liability on a third-party is difficult — but not impossible.
